Hana Report: Ongoing Detention and Lack of Information Regarding the Status of Shalir Mam-Qaderi After 18 Days

The Hana Human Rights Organization expresses grave concern regarding the continued detention and lack of information concerning the status of Shalir Mam-Qaderi, a resident of Mahabad, 18 days after her arrest.


According to reports received by Hana, Shalir Mam-Qaderi, a mother of two, was arrested by Intelligence Department forces in Mahabad on Wednesday, April 8, 2026, and transferred to an unknown location. To date, no precise information is available regarding her place of detention, physical condition, access to her family and legal counsel, or the judicial proceedings of her case.


According to information obtained by Hana, the reason for Ms. Mam-Qaderi’s arrest is cited as her association with the families of those killed during protests in Mahabad. If confirmed, her detention would constitute a security crackdown on civil and social interactions with seeking-justice families.


At the time of her arrest, Shalir Mam-Qaderi was suffering from cancer and was undergoing treatment and medication. An informed source also told Hana that her arrest involved violence, resulting in a fractured knee. Despite these conditions, no information has been released regarding her access to medication, medical examination, specialized treatment, or continuous care.


From the perspective of Iranian domestic law, this situation is inconsistent with the requirements of the Criminal Procedure Code:

  • Article 49: Law enforcement officers are obliged to immediately inform the prosecutor of an individual’s detention and the reasons for it.
  • Article 50: The person under detention has the right to inform their family or acquaintances of their arrest.
  • Article 51: The detainee or their close relatives may request a medical examination, and the results must be recorded in the case file.

    In the case of Shalir Mam-Qaderi, the ongoing lack of information, the failure to disclose her location, and the potential deprivation of medical treatment—especially considering her cancer and the reports of physical injury during arrest—conflict with these legal requirements.
    Furthermore, under Article 10 of the International Covenant on Civil and Political Rights, Iran is obligated to treat all persons deprived of their liberty with humanity and respect for human dignity. The denial of effective access to medical treatment, prolonged lack of communication, and leaving claims of physical injury unanswered may violate this commitment.

    Hana Human Rights Organization demands the immediate disclosure of Shalir Mam-Qaderi’s place of detention, her prompt access to family and a lawyer, an independent medical examination, the provision of medication and specialized treatment, and clarification of the legal basis for her arrest. Hana emphasizes that the responsibility for any physical deterioration, irreparable harm, or threat to the health and safety of this detained citizen lies with the arresting agency, the judicial official overseeing the case, and the General Intelligence Department of West Azerbaijan Province.
